By accessing, registering on or using the Savion platform, available at www.savionapp.com (hereinafter the "Platform" or "Savion"), operated by Savion App Technology, with registered office at Rua Hermenegildo Pulquério Lotes 4A, 4B, e 6, Alcabideche, Cascais, 2645-019, Office no. 30, Portugal (hereinafter "we", "us" or "Savion App Technology"), the user fully accepts these Terms and Conditions ("T&C"), as well as our Privacy Policy and Cookie Policy. If you do not agree with any part of these T&C, you must immediately cease using the Platform. Continued use after changes to the T&C constitutes acceptance of those changes. These T&C constitute a legally binding contract between the user and Savion App Technology.
Savion reserves the right to verify the identity of users, suspend or close accounts that violate these T&C, contain false information, are associated with fraudulent activity, or for any other legitimate reason, with or without prior notice, at its sole discretion. In the event of account closure due to a breach of the T&C, the user will not be entitled to a refund of any amounts paid.
To sell on the Platform, the Creator must apply for creator status and be approved by Savion. Savion reserves the right to approve, reject or remove any product at any time without obligation to provide justification, in particular when:
Savion charges a Commission of 8% on the gross value of each transaction completed on the Platform. Payments are processed via Stripe Connect. The Creator will receive the net amount (after deduction of the Savion Commission and Stripe processing fees) directly into their bank account linked to their Stripe account, within the timeframes established by Stripe. Additionally, if the Creator has activated the affiliate programme for a product, the commission percentage set by the Creator will be deducted. In the event of an active referral between creators (partner programme), an additional commission of 3% will be charged.
By purchasing a Digital Product on the Platform, the Consumer acquires a personal, non-exclusive and non-transferable licence to access and use the content for personal, non-commercial purposes. The purchase does not transfer any intellectual property rights over the content.
Savion offers a 14-day satisfaction guarantee from the date of purchase for most digital products. The Consumer may request a refund under the following conditions:
Refund requests must be sent to geral@savionapp.com. Savion reserves the right to refuse abusive or repeated refund requests. Mentoring products, communities and trading signals may have specific refund conditions indicated on the product page.
The Savion brand, logo, design, code, structure and all elements of the Platform are the exclusive property of Savion App Technology or its licensors. Reproduction, distribution, modification or use of these elements without prior written authorisation is expressly prohibited.
The Creator retains intellectual property over the content they publish. By publishing on the Platform, the Creator grants Savion a worldwide, non-exclusive, royalty-free and sublicensable licence to use, reproduce, adapt and display the content solely for the purpose of operating and promoting the Platform. The Consumer may not reproduce, distribute, sell or sublicense purchased content.
The following are strictly prohibited on the Platform:
Savion acts as an intermediary between Creators and Consumers and is not responsible for the content, quality, legality or delivery of products sold by Creators. Savion does not guarantee the continuity, uninterrupted availability or error-free operation of the Platform. To the fullest extent permitted by law, Savion's total liability to any user, under any circumstances, shall not exceed the amount of commissions paid by the user to Savion in the 12 months prior to the event giving rise to liability.
Trading, investment and financial market-related products available on the Platform are for educational and informational purposes only. Savion does not provide financial, investment or tax advice. Trading financial instruments involves significant risk of capital loss. Past performance is not indicative of future results. Users should seek independent professional advice before making investment decisions.
The processing of personal data on the Platform is governed by our Privacy Policy, available at www.savionapp.com/privacy, which forms an integral part of these T&C. The user declares that they have read and accepted the Privacy Policy.
In the event of a dispute, the user should contact Savion at geral@savionapp.com. The parties undertake to make every effort to resolve the dispute amicably within 30 days.
Consumers residing in the European Union may use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr. In Portugal, they may also resort to the Consumer Dispute Arbitration Centre or another competent alternative dispute resolution body.
Without prejudice to consumer rights under applicable law, these T&C are governed by Portuguese law. For the resolution of any disputes not resolved amicably, the parties submit to the exclusive jurisdiction of the courts of the district of Cascais, Portugal.
